Beware the top floor apartment

Pros:
Very close to NYC. Nice sized 1 bedroom. Clean and when I moved in, had been refurbished. Nice neighborhood with a park nearby. Near Asian, Indian, South American and Polish neighborhoods where a lot of good foods are available. Near LaGuardia Airport. Street Parking is available usually next to the building.
Cons:
in the winter of 2013 I moved into the apartment that was on the top floor across from the Super. If you are considering this apartment - BEWARE. Little did I know - the Super Herman is actually the Landlord's son. But they don't tell you that until you have signed the lease and your stuff is in there. That changed the dynamics a lot. The problems started as soon as I moved in. The Super and his wife were very controlling, confrontational and manipulative. You DO NOT want to live in this situation with them directly across the hall. Their kids were LOUD at that time, hopefully they are grown now and do not create disturbances like they did at the time we lived there. They screamed in the hallway every morning and made the apartment miserable because we work at night and could not sleep a sufficent amount of hours due to the noise. Also the landlord had 2 german shephard dogs that barked loudly across the street, and their noise echoed into the bedroom. So even if you slept in the bedroom to get away from the child noise in the hall, you would be awakened by the dog noise coming from across the street. They start barking at 8am and go on for hours. The Super's wife was very rude to me and told me not to ask her any questions about the apartment or knock on her door, even though that's where the Super lived. There was insufficent insulation that separated their apartment from our kitchen so they began listening to Everything that was being said in our kitchen. We are social and love to have guests over to sit in the kitchen and share drinks and stories. We were told by them that we did not have use of our kitchen after 10pm because they go to bed at that time. So we had impaired ability to use our kitchen, instead of them spending the money to place insulation into the wall between their bedroom and our kitchen. I was then told I was not allowed to store my unused BBQ grill in my kitchen because "they considered it a danger". I was planning on saving the BBQ to use in my next living situation and did not want to pay for storage of it when I had a good sized kitchen to store it in. I asked if I could store it in the basement of the apartment building but they said no. I got rid of the tiny container of Blue Rhino propane that was the fuel for the BBQ so that there was no fuel in it, but they called the Fire Department on me! Fire Fighters suddenly raced up the stairs and swarmed my apartment to combat my BBQ grill that was sitting in my kitchen being used as a plant holder. I explained the situation to them and they talked them into letting me store the BBQ in the basement. It took actual firefighters to convince them to just do a normal human favor for a tennant, even though they had plenty of room. I had a guest performer fly in from CA to stay at my apartment for a show he was doing at a local club, and he was of Mexican descent. He went into the hallway to smoke a cigarette, because there was a tennant who was always smoking in the hall who was their friend so my guest believed he could do it too. He was I guess seen by the Super and his wife. I was then told by the Super that "they did not want Mexicans in the hallway". Whaaaaat???? :O Wow. Ok, well then. I was told by the Super that the last tennant in the apartment was a hoarder and that she had an infestation of bugs and mice in the apartment for years and that they could literally hear the mice chewing through the walls. So she was finally kicked out and they had to remove 2 truckloads of stuff. So when they refurbished the apartment, the Super who is the landlord's son had used tons of pesticide and splashed it all over the floor, before putting a vinyl covering on the floor. I didn't think this would affect me, but I started to feel very sick once I was in the apartment. Within 3 months of moving in, I developed heart palpitations and started having panick attacks. I found it hard to work and do my job and I lost a lot of weight. My throat got irritated and I couldn't swallow easily. I was terrified and went to the ER, but they couldn't find the problem. I was told later on by a toxicologist that the amount of pesticide they put in the apartment was way over the legal limit and it was affecting me drastically. I had to move out and spent over a year recovering from that incident. I lost a lot of work and had my health negatively affected in many different ways by this incident. You're supposed to use a licenced exterminatior to distribute and place pesticde, not your son. He had just gone to Home Depot and bought pesticide and splashed it. That's really really dangerous. The pipes they used in the bathroom were insufficient for the needs of the toilet and sink, and it backed up and overflowed from normal use. When told of the situation, the Super was angry at me and claimed "it was my fault", that "I should have known how to turn the water off". Do I look like a Plumber??? How would I know how to control the water in the bathroom?? Overall, I thought I had lived in bad buildings in the NYC area in the past, but they were nothing compared to what happened here. I could have been seriously injured by the pesticide poisoning and was truly harmed by lack of sleep due to the noise. In addition, the downstairs tennant was nasty to me because water was leaking into the ceiling of her bathroom due to the plumbing problem. Excuse me??? I have nothing to do with the reasons why water is/is not leaking. I could have been harmed by the sewage backing up onto the floor in the bathroom. So it was far more harmful for me than it was for her. It's a building full of Narcs. Hopefully it has changed by now but this warning should go out to anyone considering this building and especially the top floor apartment across from the Super who is, again, the Landord's son so he and his wife think they control the other apartment on their floor too. I will always remember the terrible incidents that took place in the winter of 2013 in this building.
Advice to owner:
Your son Herman and his wife are actually nasty to the people living across the hall from them. If you're going to have your son as the Super, you have to tell the tennants who will be living across from him and his wife. Your dogs create too much noise, stop their barking in the morning. Hopefully your son's kids aren't as loud as they were before, they were screaming in the hall waking us up every morning. Put insulation in between the 2 apartments because its' nobody's business who that tennant has in their kitchen, how long they stay in there or what they do, if they are paying rent. And use a professional exterminator to place any pesticide, I got really sick. Fix the plumbing in the bathroom, it's backing up because most likely the person you got to do the work didn't know how to do the work properly (I'm suspecting Herman). If a tenant is hurt by pesticide and raw sewage backing up, they could sue you, and I most likely should have.
